Please read these terms carefully before using our services. If you do not agree with any part of these terms, please refrain from using our platform.

2. Definitions

• “Platform” refers to the SAVESA24 website and its associated services.
• “User” refers to anyone who accesses, browses, or uses the platform.
• “Fundraiser” refers to individuals or entities registered on the platform to raise funds.
• “Donor” refers to individuals or entities who contribute funds to campaigns.
• “Backer” refers to individuals or entities who support campaigns by contributing funds, particularly in reward-based or equity-based crowdfunding.

3. Eligibility

• To register as a fundraiser or participate as a donor or backer, you must be at least 18 years old and a resident or entity registered in South Africa.
• Fundraisers must provide accurate and complete information during registration, including certified copies of identity documents, company registration documents, NPO/NPC certificates, proof of address, and verified banking details.

4. Registration and Account Security

• Fundraisers are required to create an account on SAVESA24. By creating an account, you agree to provide true, accurate, current, and complete information.
• You are responsible for maintaining the confidentiality of your account information, including your password, and for all activities that occur under your account.

5. Fundraising Campaigns

• Fundraisers are solely responsible for creating, managing, and promoting their campaigns. This includes the provision of images, descriptions, and all other content related to the campaign.
• Campaigns must comply with all applicable laws and regulations.
• SAVESA24 reserves the right to approve, reject, or remove any campaign at its sole discretion.

6. Use of Funds

• Funds raised through SAVESA24 must be used exclusively for the purposes stated in the campaign.
• Fundraisers must provide clear and accurate financial projections and reports to backers if required.
• SAVESA24 disburses funds within 10 days from the campaign expiry date, provided all required documentation has been submitted and verified.

7. Fees and Charges

• SAVESA24 charges a fee for using the platform, which will be outlined in the fee schedule provided at the time of registration.
• Additional services, such as campaign planning, budget development, business planning, financial projections, investor pitching, and fundraising reports, are available for an additional fee.

8. Intellectual Property

• All content provided by fundraisers, including but not limited to information, images, plans, and budgets, remains the property of the respective fundraiser.
• By submitting content to the platform, the fundraiser confirms that all such content is their own original work or that they have obtained the necessary rights and permissions to use it. The fundraiser agrees that they are solely responsible for any intellectual property violations related to the content they submit.
• SAVESA24 shall not be held liable for any claims of intellectual property infringement or violations arising from content provided by fundraisers. Any such claims will be directed to the fundraiser in question.
• By submitting content to the platform, the fundraiser grants SAVESA24 a non-exclusive, royalty-free license to use, reproduce, and distribute the content for promotional purposes.

9. User Conduct

• Users agree not to engage in any activity that could harm the platform, its users, or its reputation. This includes, but is not limited to, the submission of false information, fraud, or the promotion of illegal activities.
• Users must not attempt to interfere with the proper functioning of the platform or engage in any activity that could damage, disable, or impair the platform.

10. Limitation of Liability

• SAVESA24 provides the platform on an “as is” and “as available” basis. We make no warranties, either express or implied, regarding the platform’s availability, reliability, or suitability for any purpose.
• SAVESA24 is not responsible for any loss, damage, or injury resulting from your use of the platform or any fundraising campaign hosted on the platform.

11. Indemnification

• Users agree to indemnify and hold harmless SAVESA24, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses, including legal fees, arising out of your use of the platform or violation of these terms.

• SAVESA24 respects your privacy and is committed to protecting your personal information.

13. Changes to the Terms and Conditions

• SAVESA24 reserves the right to modify or update these terms at any time. Users will be notified of any changes via email or through the platform. Continued use of the platform after such changes constitutes acceptance of the new terms.

• These terms are governed by and construed in accordance with the laws of South Africa. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the South African courts.

15. Prohibited and Unlawful Campaigns

• Prohibited Content: Fundraisers are strictly prohibited from creating campaigns that promote illegal activities, violence, discrimination, hate speech, or any content that violates the laws and regulations of South Africa.
• Compliance with Laws: All campaigns must comply with applicable local, provincial, and national laws. Fundraisers are responsible for ensuring that their campaigns do not infringe on any legal rights or regulations.
• SAVESA24’s Rights: SAVESA24 reserves the right to review, reject, or remove any campaign that it deems, in its sole discretion, to be unlawful, inappropriate, or in violation of these terms and conditions. The removal of such campaigns may occur without prior notice to the fundraiser.
• Reporting Unlawful Content: Users may report campaigns they believe to be in violation of these terms or applicable laws. SAVESA24 will investigate such reports and take appropriate action, including but not limited to the suspension or removal of the campaign.
